WHY DID I RECEIVE AN OBJECTION AND WHAT DO I DO?

  • If the objection was based on insufficient documentation, it means we could not tell from the information you sent whether your problems are ones you can get money for in this claims process. Because we cannot tell if your claim is one you can get money for, we objected to your claim. That means we are asking the court to disallow your claim. You will not get money if the court disallows the claim. If you believe that Ditech/RMS owes you money, you must file a written response with the court. The notice explains how to file a response. You must follow those instructions. Whatever you file has to be received by the deadline indicated in the notice.
  • If the objection was based on duplicates claims, it means that you sent in more than one claim. We are objection to all but one of your claims. The remaining claim is called the “surviving claim.” We are still reviewing the surviving claim. If you disagree that your claims are duplicative, you must file a written response with the court. The notice explains how to file a response and you should explain why you believe the claims are not duplicates. Whatever you file has to be received by the deadline indicated in the notice.
  • If the objection says the claim was satisfied or released, it is because our investigation showed the claim was paid in full, satisfied in the normal course of business (e.g., insurance or escrow funds were transferred to a new servicer) or you told us that you were no longer asserting a claim. If you disagree that your claim was satisfied or released, you must file a written response with the court. The notice explains how to file a response. Whatever you file has to be received by the deadline indicated in the notice. 
  • If the objection was based on an insufficient legal basis, it means that we do not believe that you have stated an affirmative legal claim for which you can receive money in this bankruptcy process. We are asking the court to disallow your claim. You will not get the money if the court disallows the claim. If you believe Ditech/RMS owe you money, you must file a written response. The notice explains how to file a response. You must follow those instructions. Whatever you file has to be received by the deadline indicated in the notice.
